By continuing to browse or use this website, and by placing an order through www.homeandbath.co.uk (hereinafter referred to as “we”, “us”, or “our”), you (the “customer” or “user”) are deemed to have read, understood, and agreed to be bound by the terms and conditions set forth below, as well as our Privacy Policy and Returns Policy, which together constitute the entire agreement between you and Home & Bath.

We understand that shopping online requires a degree of trust and transparency, and we are fully committed to offering a clear, fair, and reliable experience. These Terms and Conditions are written with care and consideration, and in compliance with the laws of England and Wales, including but not limited to the Consumer Rights Act 2015, the Electronic Commerce (EC Directive) Regulations 2002, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Sale of Goods Act 1979 (as amended), and the Misrepresentation Act 1967. Where applicable, any exclusions or limitations outlined herein are subject to these statutes and shall be interpreted accordingly.

We hope you are entirely happy with your purchase. However, in the unlikely event that you are not satisfied, we ask that you contact us at info@homeandbath.co.uk within 24 hours of the delivery date. Our team will be happy to investigate any concern you raise and will do so with a view to resolving the matter swiftly, reasonably, and in line with our company policies. While we strive to go above and beyond, it is important to note that our goodwill efforts do not create any legal precedent or waiver of our rights under contract or law.

You confirm your order for products on our website by pressing the "Confirm Order" button at the end of the checkout process. You will receive an order acknowledgment detailing the item/s you have ordered, provided the email address we hold for you has been entered correctly. If the email address is incorrect, you will not receive an acknowledgment email, and we will not be liable for any communication failures related to this. This is not an order acceptance from Home & Bath.

For items being delivered to you, when your order is shipped from our warehouse, we will send you a dispatch confirmation email. Order acceptance and the completion of the contract between you and Home & Bath will take place on the dispatch of the products ordered from our warehouse, unless we have notified you that we do not accept your order or you have cancelled it in accordance with these Terms and Conditions.

Each product purchased is sold subject to its Product Description, which sets out additional specific conditions related to that product, including, without limitation, terms and conditions concerning estimated delivery dates and times.

We will take all reasonable care to ensure that all details, descriptions, and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. However, despite our best efforts, the information displayed on this website, including product descriptions, may not always reflect the exact situation at the moment you place an order. All sizes and measurements are approximated; however, we aim to make them as accurate as possible.

Should you wish to return an item, it must be returned to us in its original, unused and resaleable condition, complete with all packaging, labelling, tags, and seals intact, within 14 calendar days from the date of receipt. This condition is non-negotiable and forms part of our core hygiene and safety policy. Returns that do not meet these criteria may not be processed, and customers are responsible for ensuring safe return shipment using a tracked and insured service.

Please note that for hygiene reasons, we are unable to accept returns of the following items if they have been opened, handled, or removed from sealed packaging: pillows, pillowcases, duvets, duvet covers, sheets, mattress protectors, mattress toppers, towels, throws, blankets, or any other bedding-related or personal-use textile item. In accordance with the Consumer Contracts Regulations 2013, these exclusions are lawful when hygiene is a material consideration, and your statutory rights remain unaffected in cases where goods are proven to be faulty. Items which are bespoke, made-to-order, personalised, or custom-processed in any way are also excluded from return and refund provisions, in accordance with Section 28(1)(b) of the Consumer Contracts Regulations 2013.

Where applicable, and solely at our discretion, we may elect to accept a return received outside of the specified time frame, though we reserve the right to apply an administrative processing charge in such instances to reflect the additional logistical and operational costs incurred.

If an order qualifies for free shipping but is subsequently returned in part or full, we reserve the right to deduct the standard shipping charge (as advertised on our site) from any refund processed, unless the item in question is proven to be faulty or misdescribed.

You understand and agree that colours, patterns, textures, and shades may appear differently on screen versus in person due to variables in digital display technology. While we make every effort to display product images and descriptions as accurately as possible, Home & Bath cannot be held liable for minor aesthetic discrepancies that do not materially alter the functionality or core identity of the product.

Our maximum liability to you, whether in contract, tort (including negligence), misrepresentation, or otherwise, shall in no circumstances exceed the total amount paid by you for the product in question. We expressly exclude any liability for indirect, incidental, special, or consequential losses, loss of profit, data, business opportunity, or goodwill, or any other losses of a non-direct nature, to the fullest extent permissible under law.

By using this site, you hereby agree to indemnify and hold harmless Home & Bath, its directors, officers, employees, agents, and affiliates, from any claim, action, demand, or liability, including without limitation legal fees and costs, arising from your use of the website or any breach of these terms and conditions. This indemnity survives termination of the agreement between us.

All risk in the goods passes to you upon delivery. Title in the goods remains with us until full payment is received. We shall not be held responsible for any damage or delay resulting from courier issues, weather disruptions, customs clearance, strikes, delays, or force majeure circumstances beyond our reasonable control.

If an order is placed by a business or retail site and we have reason to believe the order is being placed with the intention of directly reselling goods purchased from us, we reserve the right to cancel this order pre-dispatch. We also reserve the right to cancel any bulk order (for over 50 units of the same item) where we suspect that such goods may be being purchased for the purposes of resale.

In any instance where a dispute arises under these terms, the matter shall first be referred to informal resolution via email. Should resolution not be possible through informal channels, both parties agree to submit exclusively to the jurisdiction of the Courts of England and Wales. These terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to any conflict of laws principles.

Please note that these Terms and Conditions, along with our Privacy Policy, Returns Policy, and any other referenced documentation, are subject to change at any time and without prior notice. While we may, at our discretion, inform customers of substantial amendments, we are under no legal or contractual obligation to do so. It remains the responsibility of the customer to review this page periodically to stay informed of any updates. Continued use of the site or any services offered shall constitute acceptance of the amended terms.

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. If any provision herein is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.
